Obstetrical Malpractice & Fetal Monitoring

The Obstetrical and Fetal Monitoring Malpractice Lawyers at Andres & Berger, P.C. want you have this important information. During labor, most babies are monitored by either external or internal fetal monitoring. Fetal monitor strips, printed during the stages of labor, correlate the timing and nature of the mother’s contractions as well as the fetal heart rate. When comparing the mother’s contraction to the nature of the fetal heart rate, obstetricians as well as labor and delivery nurses can learn much information about the well-being of the fetus. Obstetrical malpratice can occur when the obstetrician and/or the labor and delivery nurses fail to diagnose late decelerations of the fetal heart rate or fail to diagnose a lack of beat to beat variability of the fetal heart rate. Both decelerations of the fetal rate and lack of beat to beat variability of the fetal heart rate can be evidence of lack of oxygen to the baby’s brain and can lead to brain damage or death of the fetus before or after delivery of the baby. When there is prompt recognition of lack of oxygen to the baby’s brain, the doctor should proceed to emergency Ceasarian section. Prompt delivery will usually prevent brain injury and death. Obstetrical medical malpractice occurs when the doctor and/or the labor and delivery nurses misread the fetal monitor strips and fail to cause prompt delivery of the baby.
